Acceptable Use Policy
This Acceptable Use Policy sets forth guidelines relating to the types of content that you may upload to the web servers under your agreement with Host for hosting services (the "Services"). Host may remove any materials that, in its sole discretion, may be illegal, may subject it to liability, or which may violate this Acceptable Use Policy. Host will cooperate with legal authorities in the investigation of any suspected or alleged crime or civil wrong arising from any use of the Services. Your violation of this Acceptable Use Policy may result in the suspension or termination of either your access to the Services and/or your account or other actions as detailed in the Web Hosting Agreement.
- General Acceptable Use Terms
The following constitute violations of this Acceptable Use Policy:
Using the Services to transmit or post any material that contains or contains links to nudity, pornography, adult content, sex, or extreme violence.
Using the Services to transmit or post any material that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder.
Using the Services to harm, or attempt to harm, minors in any way.
Using the Services to transmit or post any material that harasses, threatens or encourages bodily harm or destruction of property.
Using the Services to make fraudulent misrepresentations or offers including but not limited to offers relating to "pyramid schemes" and "Ponzi schemes."
Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Host or another entity's computer software or hardware, electronic communications system or telecommunications system, whether or not the intrusion results in the corruption or loss of data.
Using the Services to transmit or post any material that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying and/or distribution of copyrighted material, the digitization and distribution of photographs from magazines, books, music, video or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
Reselling the Services without the prior written authorization of Host.
Using the Services for any activity that adversely affects the ability of other people or systems to use the Services or the Internet. This includes but is not limited to "denial of service" (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited.
You may monitor your own website(s) and service(s) that we host if you disclose this in advance to Host and provide the IP addresses from which monitoring will originate. Monitoring can be no more frequent than 5 (five) minutes. You may not monitor other sites or services that we host that are not specifically and uniquely your own. Unapproved monitoring will be blocked at Host’s firewall.
- Website Hosting Acceptable Use Policy
- Dedicated IP Address Allocation
Any dedicated IP order in addition to ones provided with a hosting package may be subject to IP Justification. Justification practices are subject to change to remain in conformity with policies of American Registry for Internet Numbers (ARIN). We reserve the right to deny any dedicated IP request based on insufficient justification or current IP utilization. You agree that if the Pay Per Cloud IP numbers assigned to your account are listed on an abuse database or blacklist like Spamhaus, you will be in violation of this Agreement, and Pay Per Cloud may take reasonable action to protect its IP numbers, including suspension and/or termination of your service, regardless of whether the IP numbers were listed as a result of your actions.
All services provided by Pay Per Cloud may only be used for lawful purposes. The customer agrees to indemnify and hold harmless Pay Per Cloud from any claims resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of another’s copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being infringed upon, please email email@example.com with the information required. If the request is of a licensing issue, we may require further documentation.
- PROHIBITED CONTENT AND ACTIVITIES
- Use for Backups
The customer agrees to make use of Pay Per Cloud Web Hosting servers primarily for the purpose of hosting a website, and associated email functions. Data uploaded must be primarily for this purpose. Pay Per Cloud Web Hosting servers are not intended as a data backup or archiving service. Pay Per Cloud reserves the right to negotiate additional charges with the Customer and/or the discontinuation of the backups/archives at their discretion.
- Adult Thumbnail Galleries/Banner Exchanges
You agree not to run a banner exchange, free adult tgp (thumbnail gallery post), or free adult image galleries on your website.
- Abusive Scripts/Processes
Any script/process/etc that adversely affects the ability of any other customer to satisfactorily use their provided services is forbidden. This includes, but is not limited to, CPU-intensive CGI/PHP scripts and websites for which the scale of traffic has exceeded the acceptable limits of a shared hosting environment.
- IRC Bots/Bouncers
All IRC bots and “bouncers” (bnc, etc) are forbidden.
- BitTorrent Software
The BitTorrent protocol is not allowed on Pay Per Cloud Shared Hosting services.
- Proxy Software
All proxy software, anonymous or otherwise, is forbidden on Pay Per Cloud Shared Hosting services.
- Network Daemons
Any process that opens a network socket to accept connections from external networks is forbidden. Processes are allowed to bind to the local host only, but are held to the limitations placed on all other processes. They must not use up more than their fair share of resources and they must not interfere with any other customers’ activities.
- Access to Third-Party Systems
Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Access to networks or systems outside of your direct control must be with expressed written consent from the third party. Pay Per Cloud may, at its discretion, request and require documentation to prove access to a third party network or system is authorized.
- Child Pornography
Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita):
- Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.
- Resellers: we will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; more than one infraction of this type may result in the immediate termination of your account.
- Direct customers: Your services will be terminated with or without notice.
- Violations will be reported to the appropriate law enforcement agency.
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists", purchased lists, and selling of lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
Pay Per Cloud reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean-up fee or any charges incurred for blacklist removal. This cost of the clean-up fee is entirely at the discretion of Pay Per Cloud.
- Other Prohibited Activities
Anonymous or Bulk SMS Gateways
Forums and/or websites that distribute or link to warez/pirated/illegal content
Image Hosting Scripts (similar to Photobucket or Tinypic)
Mail Bombers/Spam Scripts
File Dump/Mirror Scripts (similar to rapidshare)
High-Yield Interest Programs (HYIP) or Related Sites
Investment Pyramid Schemes
Sale of any controlled substance without prior proof of appropriate permit(s)
Hacker focused sites/archives/programs
Sites promoting illegal activities
Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)
Commercial Audio Streaming (with more than one or two streams)
- Enforcement by Pay Per Cloud
Pay Per Cloud systems may be monitored for all lawful purposes, including to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of Pay Per Cloud system(s) constitutes consent to monitoring for these purposes.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.
Sites hosted on Pay Per Cloud’s service(s) are regulated only by U.S. law. Given this fact, and pursuant to U.S. law we do not remove allegedly defamatory material from domains hosted on our service(s). The only exception to this rule is if the material has been found to be defamatory by a court, as evidenced by a court order. Pay Per Cloud is not in a position to investigate and validate or invalidate the veracity of individual defamation claims, which is why we rely on the legal system and courts to determine whether or not material is indeed considered defamatory. In any case in which a court order indicates material is defamatory, libelous, or slanderous in nature; we will disable access to the material. Similarly, in any case in which a US Court has placed an injunction against specified content or material; we will comply and remove or disable access to the material in question. Pay Per Cloud is a republisher and not the publisher of content. Our service merely provides a hosting platform and space on which to host content, and any creation or publication of content on our services is the sole responsibility of the third-party user which creates or publishes the content. Therefore, Pay Per Cloud should not be held liable for any allegedly defamatory, offensive or harassing content published on sites hosted under our webhosting service(s).
Pay Per Cloud reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion. Violations of the Terms of Service will waive the refund policy.

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. Whenever possible, set permissions on directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.
- Backups and Data Loss
Your use of our service is at your sole risk. We keep a limited number of backups solely for our recovery from disaster and not for your recovery of accidentally deleted files
- Cancellations and Refunds
Pay Per Cloud reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice. Violations of the Terms of Service will waive the refund policy.
- Reporting of Violations of This Acceptable Use Policy
Host requests that anyone who believes that there has been a violation of this Acceptable Use Policy to immediately send an email detailing such violation to firstname.lastname@example.org.
